What you need to know is this:
1. A class action involves a filing by (or individual on behalf of group) a group of people claiming or suing in court based upon the same cause of action by way of factual evidence. Example: The Bhopal India gas poisoning from the chemical plant that
had an accident. One attorney could sue for the 200,000 more people that was injured. That attorney would collect 30% fee from each of those individual's awards.
2. Example: An individual can sue on the behalf of a class as long as they are related in the cause of injury by way of fact of their status. The status of being in a protected class by law over the age of 40 is an example. If one can prove that a company is constructively termination employees as they reach that age or are in that age and that the age was the determining factor you or any one can file on behalf of others if that we provable.
3. Example. Class of people can be stock holders. If one stock holder of company XYZ claims fraud or wrong doing by the company XYZ causing a loss that stock holder when suing for himself can sue on the behalf for every other stock holder.
The fact is nothing is different for the most part from an individual law suit and a class action. Class actions suits are welcomed by attorneys as they make far more money. Attorney can argue one case for thousands of people and make a lot of money for himself.
