One of my tenants did not pay for my rent i call her and she wont answer me in a month?

i filed the paper work for court and she picked up her clothes and some light stuff and left and have not been in the apartment 2 weeks. i called the police because i was not sure if she was still living there or if she was dead or something so the police gave me permission to open her apartment and all she got left there is a bed a tv and a dresser. by law since she moved and haven't been here in two weeks can i take my apatment back and rent it or do i have to wait about two months to go to court?

depends on the state. call an eviction lawyer to see what you can do!

it is according to the law of the state in which you live. is the electric & gas in her name. has it been terminated by her or the utility? if the utility co. turns it off your chances of getting a judge to give an immediate eviction notice may be better. do not give her a reason to sue you. i would file against her in smal
claims court for lost rent and all associated fees. if your state has a lottery she may win . then you will get your money before she gets hers because all judgements must be paid first.

I don't know about New Jersey, but it sounds like a case of simple abandonment. Round here, those are the easiest evictions to handle. You go in, take the stuff, sell it if you can, and use any proceeds to cover any expenses you have. But New Jersey's likely to be a lot different than here.
