Police officer issued me with a warning ticket about speed but is now saying it was for insurance help?

Postby bret11 » Tue Apr 17, 2012 3:16 pm

The full story is i was driving a friends nans car which i knew i wasnt insured . As i got outside my friends nans the police officer put me in the back of the car and questioned me. Asked me 'if i had a licence and insurance 2 drive the vehicle ' i told him yes i have a clean licence and the insurance is any drivers and he took my word for it . He didnt check no insurance details neither did he ask me 2 produce any documents. He just gave me a pink warning ticket and the offense says 'speed RTA 88 ' which i believe is just a warning. It says on the ticket 'no further action will be taken on this occasion' . But now i am going to court ? Can someone help ?

You make no sense. Try adding more details.

Did you get a court summons?

If it was just a warning, I doubt you can get in trouble for it.

Around here, you have to sign your tickets before they can actually give you a fine for it. (unless its a parking ticket) Otherwise, they can't send you a ticket through the mail later.

On that pink slip, make sure it doesn't say something like "We have the right to fine you in a case where we find evidence of lying..." something of the sort. Then you signed it.

What is now saying it's for insurance? Slow down and explain.

if you are going to court due to something like this, I'm guessing you received a court summons, so what does it say you are being summonsed to court for on the summons?

If you havce an insurance policy that covered you to drive the car at that time take it to court and it will all come good in the end.

Insurance laws are different everywhere, but around here, an insurance policy only has to cover people living in your household, but others can drive the car if they are of age and properly licensed.

Your bigger problem is that it looks like you were caught on radar at 88 MPH. I don't know many police officers that would give a warning for that kind of speed under any circumstances. How are you going to court if he didn't ask you for your license? How did they know who you are? this doesn't add up.

If you were bagged at 88 MPH, prepare to lose your license and for a pretty hefty fine when you get to court.

Alot of lost Yanks answering on the UK&Ireland site so this IS the UK answer.

RTA 88 = Road Traffic Act 1988 and covers a few things.

First thing, you were not insured as for your insurance to cover you on someone else's car the other car must be insured to the UK minimum legal requirement (at least third party). As you already admitted it wasn't so now after checks on the vehicle you have been found to be driving uninsured, the police will NEVER let you off if uninsured and you may find as well as you getting at least 6points and a fine, the owner that permitted you to drive the vehicle may get the same fine and points.

You were let off the speeding offence but that is nothing compared to no insurance.

If you are trying to ask why you are going to court, I do not know. Perhaps you know, but you neglected to mention it.
