Received class action lawsuit letter in mail regarding my employer?

Postby dallen47 » Thu Nov 24, 2011 5:22 pm

I received a letter in the mail informing me that my employer is being sued by the [undisclosed] Superior Court. It is a class action lawsuit and the plaintiff is suing on behalf of all [undisclosed] employees for unpaid wages. Now, my knowledge of litigation is limited, so I would much appreciate if you could answer a few questions I have..

1. How likely is it that the plaintiff will win the case? (Considering the superior court of a big city sent me this letter, I'm assuming it's a pretty big case.)

2. Since he is suing on behalf of all employees, if I just sit back and shut up, and not remove my name from the list, will I be compensated if the plaintiff wins (even if I personally have not been significantly affected by said claims)?

I am not condoning this type of morality nor have I expressed any desire to engage in any of the situations proposed in this question. If you could simply give me a ballpark figure of compensation for given scenario, and how likely it is that the plaintiff actually wins, I'd appreciate it.

Thank you.

First you must find out, how the employees were underpaid, and see whether that relates to you.

If you were not under paid, then you should not be reciving money.
If you were underpaid, then the payout, should be whatever you are owed, inback wages.

Suffice to say , if the company gos into recievership aka bankruptcy because of the class action lawsuit. You may only recieve a few cents in the dollar, as opposed to th full sum amount.
