Removing Lease Finance Group Adverse Account On Credit Report

Hi!

In 2003 I paid a contract off early with Lease Finance Group, Inc.(LFG)  Per their contract for termination I paid off the outstanding amount plus a pay off early fee.

While applying for a mortgage they reported an account that had derogatory comments.  After pulling ALL my credit reports only one reported an ADVERSE ACCOUNT.  TransUnion reported the above company as an ADVERSE ACCOUNT. On the TransUnion ADVERSE ACCOUNT section it states:

“Settled-Less Than Full Balance” WRONG-it was actually paid off completely plus some.

“High Balance: $1,345.” WRONG-I paid a total of $1,985.

“Date Closed: 6/2003” WRONG-My last payment of $640. was paid on 7/2003 and cashed on 7/24/2003. It also states: PAID OR PAYING AS AGREED.

Estimated date of removal: 5/2010

I contacted TransUnion and they told me to contact Lead Finance Group that it was THEIR reporting-THEIR fault.

Per Lease Finance Group they stated the account was paid off satisfactorily and that I had the correct information and TransUnion reported it wrong.  And I could take it up with Legal by faxing all my information, which I did, which has gotten me no where.  No response, no humans, just a run around.  After repeated calls and being transferred all over LFG I went back to TransUnion.

I filed a dispute with TransUnion and supplied all my documentation, proof of checks, copy of contract, faxes to LFG legal team, etc.

TransUnion responds with…”based on our investigation of the account: VERIFIED, NO CHANGE.” Furthermore…”you may request a description of how the investigation was conducted along with the business name, address…we may have contacted for information.”

My response…”Please supply me with an exact description of your investigation that resulted in a “NO CHANGE” response.”

TransUnion’s response…”We contact them by mail, electronic means or telephone.”  (no contact information, no documentation proof, etc.)

How can I get this removed?

TransUnion will let me add "a 100 word consumer statement" ---should I do that? if so, what should I write? Should I even worry about it?  According to the TransUnion estimated removal is 05/2010.  I don’t trust them, especially since it's "estimated".

I’m flustered by all this.  Your help is much appreciated.

Susan:

You have rock solid violations of the FCRA against both Trans Union and the furnisher of information.  If this has caused you any damage; i.e., morgtgage decline or a higher rate, I'd advise you to consult a consumer attorney and institute a civil action.
