Short sale conflict of interest with law firm?

Postby adamka » Sun Mar 04, 2012 11:46 pm

I put an offer in on a short sale on 10/27/2011. A law firm here in Vegas (where I'm located) is processing the short sale.

I just leanred that the law firm has been renting out the house that I put an offer in. They state that its actually better to have a tenant there during the process (hard to believe as I know they have a dog, that and when I put an offer in the house was in gorgeoous shape, who knows what it will be like afterwards when they move out).

My question is this: Is it conflict of interest that the law firm is collecting rent payments on the house they are representing me in. Why wouldn't they take their time with the short sale process as they are making $ every month this wait takes place. Very frustrated I just want my house. Ps I made a cash offer as well, and my Realtor is my brother who is licensed.

Any help is greatly appreciated.

"Is it conflict of interest that the law firm is collecting rent payments on the house they are representing me in."...If the law firm is collecting rent, then they clearly aren't representing YOU. More likely, they are representing the bank who owns the property and the two split the rent in some way. But that law firm does NOT represent you and has NO OBLIGATION to you. The only one representing you is your brother. And whether having a relative represent you in such a matter is highly questionable...at best. Besides, short sales typically take several months to conclude. Though it seems like it should be time for someone (the bank) to sh^t or get off the pot.

There is NO conflict of interest. The law firm represents the interests of the BANK, both by handling the short sale on THEIR behalf., AND by renting out the home until the sale. They are NOT representing YOU at all. Your brother is the ONLY party involved that is ALLOWED to represent your interests, and if he has not explained that, he isn't doing his job very well.

Tom: Having a relative represent you is not even SLIGHTLY questionable. It is the COMPETENCE of the brother that allowed Robert to not KNOW the answer to this question that is questionable.
