Should take my ex husband to small claims court?

Postby jerard » Fri Apr 06, 2012 10:40 pm

I just divorced my ex husband. We had 2,000 dollars in debt together. Our names were on each account. He agreed to pay me half. I paid the 2,000 but now that I paid the debt then he says he isn't paying his half. I even gave him the option to pay me 200 a month until the debt was paid to me. I have two young children and I am trying to start over its not fair for him to do that to me or our children. Should I take him to court? I paid all the debt at once so I can have my own place when the landlord checked my credit. I left him.

Small claims court is not like a divorce court. It reserved for paper-to-paper matters, for example, if you didn't submit in time some paper requesting reimbursement, say, for car work-related mileage - small claims is that place. Try re-posting in "Law and Ethics" category on Y!A, and there you might get the answer.

Hopefully you have this is writing and its in your divorce decree. If it is not just chalk it up to one more reason you divorced his butt. Good luck!
