Small Claims Court....signature required?

Postby motega » Sat Apr 21, 2012 11:46 am

If somebody is threatening to take me to court don't I have to first sign a letter from the post office or mail carrier that I received? If so, what if I choose not to sign? I know eventually I'd have to go but was wondering what happens because technically, I don't have to sign for anything if I don't but do understand if its a court case there must be ways around that they can still schedule a date.

Thanks!

You have to be served by a "disinterested third party", and no signature is required. The server has to file a statement regarding the lack of interest, and the date/time/address at which you were served.

For small claims, in most states no signature is required. If the paperwork was mailed to the correct address, the judge will assume you received it. If you fail to check your mail, it is your own fault.
