UK LAW: For my legal purposes, am I lawfully allowed to record my boss without consent?

Postby bellden » Sat Jun 23, 2012 4:01 pm

I've had a little trouble at work and would like to know if I can record conversations between me and my boss to protect my rights as an employee; use recorded information against my employer for several breaches of acts and various legislation. I have been to the citizens advice bureau however I would like to take legal action and I have a solid case for sure + evidence. Just need to back myself with the correct legislation and employment law...so a few questions...

1) What would you do in a situation where you've been treated unfairly and felt that you couldn't talk to your employer? (As you would only be lighting yourself up as a threat and feel that it would affect your employment status...)

2) I'm in need of an employment solicitor right...but my job position leaves me with relatively low pay and irregular work and feel that I am unable to pay for a solicitor...the question is - Can I get an employment solicitor appointed to me free of charge? What would you recommend?

3) I feel that regarding my case, I need help representing myself to get across what I actually want to get across regarding breaches and injustice...If it came to an employment tribunal, how does representatives work? Can my solicitor represent me?

4) Have you had an issue at work? How did you resolve it?

I haven't covered all aspects of whats on my mind however just a few which I feel that a little help would go a long way. Thank you in advance, any help/suggestions is appreciated! :(

Legally no. But for your defense / safeguard you can do many things without being caught.

First answer is wrong, legally you can record them in the UK,

but ...

Anything you record is inadmissible unless they KNOW you are recording.

I suggest you leave and claim constructive dismissal (i.e. it is so bad you were forced to leave) but hurry up about it, the Government are going to change the rules on this, employment tribunals will start charging soon.

If you join a trade union, sometimes they will help with the cost of solicitors - but only if they think you can win.

It's quite rare that the little man wins, unfortunately, the law is 99% in their favour.
