Underage Drinking Law in California on Private Property?

Postby ring » Fri Oct 28, 2011 6:48 am

My Fraternity is hosting a party 18+ at my house it can be considered a flyer party but we will not be providing alcohol but it will be allowed. We are making BBQ and having Soda and Water for sale. The fraternity decided to host a beer pong tournament but the participants must provide there own beer. I will be the DJ of the night so i will be able to control the noise volume. Now my question is will the cops be able to fine us for underage drinking at the property or anything under that circumstances. I'm confused on the law and just want to inform myself on the possibilities. Now this is just assuming the cops arrive. I have thrown parties at my house before and i have never had the cops come bust it up.

Underage Drinking Law in California on Private Property?

First, under state law if the police lawfully enter a private location (such as for a noise complaint--your neighbors do not have to agree not to call the police) and there is underage drinking with no parent present they can seize all the alcohol. (Business and Prof. Code 25662(b).) Second, many local governments have ordinances prohibiting underage drinking in private places. I would guess such an ordinance is more likely near a college. Third, whether there is a violation of law or not you may be in violation of college rules, which could affect the standing of your frat.

Unless you take measures to prevent underage drinking at your party, you're responsible for it, even if they brought the booze themselves. You are providing the facilities for their drinking.
