Unpaid labor wages help,help?

My aunt worked for a girl that is an independent contractor and has always been paid in cash, but now the girl refuse's to pay her for no reason at all. The girl she works for is considered an independent contractor through banks. She Takes pictures of forclosed house's. The lady My aunt works for is paid in cash and given a 10-99. My aunt is never given a 10-99 and has been always paid in cash. She has worked for this lady for a couple months, maybe a few months.

This lady that my aunt worked for has no business of her own so i am not sure if my aunt should file a claim with the labor board, or if it has to go through small claims court. I would guess its through the labor board.

The evidence my aunt has is she has text messages from her stating that she knows she owes her the money....So she actually has text messages for proof if needed.

This lady believes my aunt has NO CASE because she is an independent contractor and doesnt own a business.


Does my aunt file her claim against this individual through labor board or small claims?

May i add also, that my aunt worked WITH this lady and was not contracted through this lady.

I beleive she should be able to go through the labor board sense she worked With this lady and wasnt contracted the work.

Sadly unless there was a written contract, your aunt has no claim in small claims court.
