What can I do if I am falsely accused of slander?

Postby edmondo93 » Sat Apr 02, 2011 12:52 pm

I have looked up all the slander laws but I'm still not sure what I can do about it, or if false accusations of slander are considered slander. A local bar is accusing me of slander and mutiny because I posted a link on facebook to someone else's post. I have looked both up and know that I did neither and defamation does not include re-posting someone else's words on the internet and I also know that it would be libel not slander, and that I came nowhere close to committing mutiny but I am unsure what I can do about falsely being accused of slander. It wouldnt matter if I didnt work at another bar in town and they werent telling everyone that I commited slander and mutiny because it hurts my sales and reputation.

Mutiny? Is this bar aboard a ship?

You posted a link to another post on Facebook, and as a result have been slandered? What did they say about you that you consider slanderous?

If you've been falsely accused of slander, there's nothing you can do but wait to see if they sue you. If you want to sue them, you will have to prove that what they said was both a lie and maliciously intended to harm you, which is pretty tough to do.

I think the best thing to do is just forget about it.

Your only defense is the truth. If it is the truth, then it isn't slander.

"What can I do if I am falsely accused of slander?"

Accused where? If you weren't the one who actually wrote the defamatory claim, why would the bar go after you? In any event, you probably did more than just link to the other site or blog.

"defamation does not include re-posting someone else's words on the internet"

This is why the world needs lawyers. Laws are based on common sense, but selectively interpreted by people who discard their own.

A civil claim is based on a right which is interpreted in a way preserve that right. The bar is legally protected from defamation by the right to sue those who communicate that defamatory information - whether by going on TV and saying, or posting it on the internet or by posting a link to it on the internet.

While there are limits to an action that could be brought, It doesn't matter that you didn't come up with the slander or libel or whatever it was - it's the communication of that information.

"I am unsure what I can do about falsely being accused of slander"

If you are accused of something, then you defend yourself. How could you not be sure about that?
