What exactly does this charge mean?

Postby caelin » Mon Dec 19, 2011 4:02 pm

This is probably a strange question, but I need some expertise. Unfortunately, yesterday my boyfriend went to jail. He has a small history of selling drugs for the money, never for use (not that I ever supported it, but anyways). He did some time in the summer and was released, because he won his case. His mother called me this morning to tell me. She didn't tell me what he was in for, but I figured he had a warrant or something to do with his drug dealing. I went to our county website only to see a different charge. This is the charge that was listed:

PC368(D)
THEFT:ELD/DEP ADULT $400+
PC487(A)
G/THFT:$/LABOR/PROP $950+

Now, I am a huge idiot when it comes to stuff like this. I figured "G/Thft" was grand theft of some kind. But it doesn't list auto, so I don't think it was a vehicle he stole. But the charges I just copy and pasted look like 2 different ones. I have no idea what this means, what he did or anything I don't even know when he would've had time to do this, he's with me every day. Sure, we part ways for our jobs, but I don't understand. Maybe it was something he did that just now caught up to him? I'm going to call the sheriff's department tomorrow morning, but I can't wait that long. I need opinions.

The thing that REALLY confuses me is, when I pull up his booking information, it says bail is ineligible. I guess that either means it's not necessary, or it's really bad. I have no clue, but I need to go talk to lawyers. I'm all he has. Somebody, with the knowledge of the law, PLEASE. I need your opinions and expertise. I won't be able to sleep tonight.

Please do not attempt to answer this if you really have no idea. I need serious answers, only. I'm a wreck and I don't know what to do now. I would really appreciate it. Thank you.

grand theft doesnt have to be a car...once you go over a certain $$$ amount it becomes grand theft....in NY anything with a value over $1,000 is grand theft....
grand theft becomes a felony at that point

the bail part, probably means that desk bail cant be issued and the person has to be arraigned by a judge who must set bail
in NY, any felony has to be seen before a judge and bail cannot be set the PD.
we can set bail on misdemeanors...up to $500

also if he had 2 prior felony convictions...bail cannot be set...thats the 2 strike rule...that may be what it means too.....

if he did time...his case for the drugs was not dismissed...that was his sentence and why he was in there to begin with

PC368(d) is (d) Any person who is not a caretaker who violates any provision of law proscribing theft or embezzlement, with respect to the property of an elder or dependent adult, and who knows or reasonably should know that the victim is an elder or dependent adult, is punishable by imprisonment in a county jail not exceeding one year, or in the state prison for two, three, or four years, when the money, labor, or real or personal property taken is of a value exceeding four hundred dollars ($400); and by a fine not exceeding one thousand dollars ($1,000), by imprisonment in a county jail not exceeding one year, or by both that fine and imprisonment, when the money, labor, or real or personal property taken is of a value not exceeding four hundred dollars ($400).

PC 487(a) is Grand theft is theft committed in any of the following cases:
(a) When the money, labor, or real or personal property taken is
of a value exceeding nine hundred fifty dollars ($950)

Basically it menas he stole more than $950 or something valued over that amount. Probably from an older person who cannot take care of themself and must have a caretaker.

PC368(D)
THEFT:ELD/DEP ADULT
He stole form an a senior citizen older than 65 years old

PC487(A)
G/THFT:$/LABOR/PROP $950+
Any thing stolen over $950 in California is considered grand theft

It says bail is ineligible because your Boyfriend is not allowed to get bail

Gary you can get a desk appearance ticket in NY for a class E felony so long as not for a sex offense. Bail, if warranted, will be set at a maximum of $750. I have released people for class E felonies before. It sounds like he has been charged with two separate larceny charges one a felony and one a misdemeanor. Every state has different thresholds for their crimes.
