What happens at the end of a tenancy if landlord did not request a deposit?

Postby matchitisiw » Tue Apr 10, 2012 8:31 pm

I have been in this property since end of June 2011. The landlord didn't want a deposit just the months rent in advance.

Everything is clean and newly painted back to original move in condition so what happens at the end of the tenancy? I'm moving out on the 14th of this month. My months.notice ends on 2nd May. What happens in this instance in regards to rent? I pay on the 27th of each month in advance. Am I right in thinking that I don't pay this month on the 27th for the period 27th to the 2nd? Or do I pay for those 5 days? Does he owe me money? So confused!

You ALWAYS have to pay rent at the start of the month. If you don't you can be evicted and sued.

No, you would NOT pay your rent on the 27th. Don't listen to anyone else here who is telling you to pay it, that makes no sense at all. Why on earth would you pay a month's rent for 5 days after you already moved out? You gave your notice, paid for the month of April, you are all set.

Your thinking is most probably incorrect. In all states (other than California) a thirty days notice to vacate is NOT 'thirty days'. Rather, it is a notice for one month's tenancy agreement. If you engaged in a tenancy agreement with rents due on the first of the month, you must give notice one 'rental period' in advance. Your landlord is NOT required to 'pro rate your rents' by the day.

did you give the LL a notice 30 days in advance; it appears so. I am a bit confused;
notice ends on..............may 2, leaving 14 may. I pay on the 27th of each mo.

Ordinarily, one's notice would be ahead of leaving and would END the tenancy on the day
of move out.

so, it could just be your language. TO be SUPER Safe, make sure you attend the
exit walk through and take pictures of everything............[digital of course]

leave not one scrap or any trash.

leave it so anyone can move right in and make sure your utilities are turned off on your
move out date! Inc the mail!

Can guide you further if desired.

You pay and then rent is refunded when you leave, or if he agrees, you simply pay prorated rent for the two days of May. You of course pay for any and all time you have the unit.
