If the country does not have a law where they have to punish or deport the criminal back to his origin, what happens?

if there's no agreement between the countries on deportation, then the criminal will go unpunished... provided they remain in the given country

In that case, the criminal basically gets away with it. However, if he returns to the country where he committed the crime, or another country that does have an extradition treaty with the original country, he can be arrested.
