Tenant is refusing to pay her utilities. She is claiming that because the accounts are in my name that she does not have to pay. In our lease it states that Landlord will arrange and bill tenant for utilities. There is a sub meter to calculate her portion of the electric bill but she is claiming it should be billed in thirds. She didn't pay April & May. I wrote her a letter giving her options on how i was willing to resolve the issues. I gave her 1 week to choose an option and told her that if she didn't choose any options i would be giving her a notice stating she has within 30 days to vacate. She didn't choose an option so I gave her a notice on June 14th to vacate property within 30 days. I also put in the notice that she could stay if she paid all past due bills and picked one of the options. She did pay her past due utilities finally on July 3rd. Can i still go to district justice and file for eviction if she is not out by July 14th? Can i still have her evicted because we cannot agree on how utilities should be billed? Also she has made false claims regarding the water. She said it was making her very sick. I had the water tested and results came back that the water is perfect and could not have made her sick. Really lost on what I should do regarding this issue. Tenant and I simply do not agree what should I do?

no
because you accepted her payment.

The law says, you can't have your cake and eat it too.

give her the utility bill still unpaid and she gets 3 days to pay it to you.
you can't say "I will do this" instead of going to court.

so, if she does not pay, you give her a 30 day notice "you are hereby being
evicted--you must be out by x date. And you must attend for the exit inspection.

if she is not out on the 30th day, you go to court [dif states, dif language]
for a WRIT OF RESTITUTION--if you don't care about money she owes you
and if you do want that--you instead, first, seek an UNLAWFUL DETAINER.

at this hearing, if she shows up and pays all past due payments [unlawful detainer]
she is good to stay

if you just want her out, you seek a WRIT OF REST......

with that, you go to the sheriff's office and pay their fee for service. and
they will remove her.

You told her she could stay if she paid and she did. Next time dont give her the option and just evict her.
