What will show up on a FBI criminal background check?

Postby leland » Tue Jul 17, 2012 4:02 am

If a state preforms a fingerprint background check on you for a professional license, what will, and what wont show up on your rap sheet? (ie, crimes, infractions, civil matters, traffic tickets). 9 years ago I was given a park curfew infraction ticket. No arrest or fingerprinting, I was just issued a ticket. I went to court, pled guilty to the infraction and paid a small fine. I'm applying for a state license in the health field ( in a completely different state). They preformed a livescan fingerprint background check. Will a non-traffic infraction show up on a background check, where no arrest or booking was made? On the advise of friends and supervisors I answered "no" to the question " has you ever been convicted of a violation of the law". The reasoning behind answering no is because this is considered a non criminal offense. I've passed the same background check for a lower level license 4 years ago. But I'm worried sick that, it may show up this time and I will be denied my license for not disclosing this infraction. What should I do?

I would have answered YES to the question, since you plead guilty to an offense. The ideal would be for you to consult your attorney on this matter as soon as possible. If not, contact the licensing agency to amend your application, if possible.

When we do background checks in my office, we get reports of minor infractions (misdemeanors) as well as serious offenses.

Generally , everything shows up on an FBI check. But if you where not arrested and where never fingerprinted, you should be ok. It sounds like what you received in the park was a summary offense . Which is like Jay walking or running a red light, disorderly conduct. You can always run a check on yourself through the state police in that state to see what they have in their repository. But you will be ok on this one.

By "law" it is meant state or federal law, not a city bylaw.

A park curfew is most likely a city bylaw and makes not diff to anyone.
If anyone wants to deny you a job because you went into a park at night long timer ago, I don't thiunik you'd want to work for such an organization anyway.
