With small claims court in TX ,if it exceeds more than $10,000 you have to file it much differently and it?

can be complicated and cost more. If one was to decide to "eat" (take a loss) on anything above $10,000 ,that one individual should be able to do that ,to keep it at the regular court for balances sued for under $10,000? After all the extra fees and paperwork I find it better to forgive some of the debt.

?? What is your question, whether you CAN simply drop your claim to the maximum Small Claims limit? Yes, you can, and yes, you are right, it is often a lot cheaper to drop some of the claim than go through the added expense of a court trial.

Most laymen cannot get through a civil case without the assistance of a lawyer. Small claims court is a much simpler process.

Where I live (Manitoba, Canada) you can certainly take something to small claims court even if your losses are more than the small claims court limit, as long as your claim only states the limit amount.

I certainly wouldn't recommend if your losses were like $100,000.00 but anything under say $20,000.00, I say go for it.
