Wrongfully Accused Of Theft - When Can I Sue For Defamation?

Postby golding » Sat Jan 11, 2014 5:45 pm

I reside in Arizona. I assisted some boxes are brought by a buddy to your man remaining in the neighborhood homeless shelter. The man was an associate of both my buddy and I. A lot of harassing text messages had been sent by him to us, following providing the containers and I filed harassment charges against him. He turned about and he'd filed harassment charges against me also because when he wrote to me I wrote back telling him to leave me alone, to fall my quantity and stated I was threatening him. Law enforcement approached me and informed me that it appeared so actually juvenile and to just not talk to him or make contact with him, to generally ignore him. And so I did. Earlier this season then I discover, he filed charges against people claiming we took "roughly $1000.00 of house products". The charges have been filed in July of a year ago, he'd no evidence, he lied on his affidavit and the detective investigating the case had phoned my buddy asking her in the future in and make a statement concerning the robbery charges, my pal rejected stating that she'd a brand new job and why could not she make the statement within the phone, she by no means heard from the detective and the detective never phoned me so charges had been filed, I was informed that because my so known as buddy did not appear to offer a statement this was making her look as if she and I are accountable.
Following discovering regarding the charges and the accessible assure on me, I placed relationship and am presently along the way of proving my innocence, we have however to go to trial. My issue is, in the end is confirmed and it is demonstrated he is emotionally unstable, and a liar and lied on his affidavits, when must I sue for defamation? Lately, he sent threatening texts to me declaring that he would have me raised on "federal" charges (he doesn't realize the distinction among State and Federal Crimes), as a result I visited law enforcement and filed harassment charges as soon as far more, they got my record and are continuing to appear into not just my harassment claim however the claim of an other woman who this psycho has psychologically tortured. Iam actually upset that anybody could feel this person, the D.A., the initial Investigator, I need retribution, what should I do?

No, heis in and from the protection but so far as I realize, now he's operating as a bus driver for just one particular of the neighborhood colleges and comes with an apartment in a seedier section of town. I'd absolutely appreciate for the harassment charges against him to stay, I'd to commit funds to bond myself out, commit each day in prison whilst they ready my bond and my information, had time from my kids, have spent many sleepless nights producing myself ill inside the depravity and pure madness of the man and have worried he will break proper into my home and harm my youngsters. I want correct justice but at this minute, I am so ashamed to reside in a area that will actually take this man's word inside the word of an upstanding person who provides to her neighborhood and is just a beneficial particular person in society. He's been taking this crap simply because he was 14, therefore I've noticed anyway, he's now 38 and continues to be ongoing this and no one has halted him. The girl he was blackmailing may well have stopped him fairly a long time ago however for whatever explanation, she gets some thing out of his madness, she gets one thing out of the crisis. I am just sickened by all this. I perform very tough keeping a pleasant standard life for my children and I and this complete problem is just that, a nightmare.

Perhaps you have talked for the Investigator? Has he ever attempted to get hold of YOU?
The question that immediately found my mind was- Why would a man getting into a homeless shelter have $1000 worth of home garbage?
Did he make an accounting of that which you apparently took? Iam just thinking what he's claiming was worth $1000.

For the time being, concentrate on the costs against you. You need to examine statute of limitations difficulties with your attorney. You are able to contact some lawyers in your town to determine what they'd cost to create a defamation action or, on the off chance, that someone would get it done on a contingent fee schedule. As it does not seem like this individual is collectable in any substantial way, and it does not seem that there would-be any insurance policy, lawsuit might be a substantial money-losing proposition.

Statements made to the cops are absolutely privileged.
Translation: You do not have a defamation case.

Is this guy still homeless? If he doesn't have any money, there's not much point in suing him. (Suing him will cost you money.)
