We closed our year rent subsequently end-of Aug.  whenever we closed the rent the compliance company had still not completed our paperwork and gave their stamp of approval.  We reside in "affordable-housing".  I've provided them every paperwork they've requested.  We began this method in June. We were currently residing in another complexe of exactly the same apartments.  Therefore we were currently residing in "affordable-housing" and our  finances remained unchanged.  Our issue is that this...should the complainace workplace choose we're not permitted reside below does that emptiness our 1 year rental?

Our expertise has-been that people do not typically perform Sec 8 rents until they've been authorized for plan,  and LL wouldn't typically permit one  in t/o acceptance--because it is just a pain to evict & most instances if you do not have acceptance you're not able to spend by yourself. My memory is when tenant dropped acceptance that alone wouldn't provide me as LL reasons to evict them--when they settled on own I'd have to recognition rent--when they breeched rent by nonpayment I'd have to do due process  to evict--however in NO SITUATION may I simply leap to state rent EMPTINESS and throw you--and least not be inside the legislation and achieve this.   But Iam NOT inside your condition and you will imply another plan......

I will double check the lease but I dont think there was anything about that in the lease.  It is section 42 housing through a group well know in the US. N_P Group.  Thanks for the info.

not eligible to live here does that void our

1 yr lease? There's really no way to answer that question without reading the lease and studying the "affordable housing" rules or codes.
What does your lease say (if anything) about failure to meet the eligibility requirements?

After reading that I conclude that it's up to the landlord to qualify you as low income so he can get the tax credit.
If he fails to qualify you he loses the credit.
That has nothing to do with your lease. Once you are in, you are in.
And, as long as you gave the info and signed the form, you are correct that unless you quit paying rent or become a legitimate "problem" your lease stands.

Read the Arizona Residential Landlord Tenant Act and save a copy to your computer or print it out.

Just because you are low income doesn't mean you shouldn't be aware of your rights and obligations as a tenant.
And if you have more questions about your rental situation, put them here in this thread and it'll bring it to the top of the active list and I'll check it out. I was a Phoenix landlord for 20 years and know a few things.

I examined the rental plus they just point I came across was an addendum concerning the LIHTC program stating when I declined to provide them my data or declined to signal a tenant accreditation type is recognized as low comliance and leads to instant termination.  Therefore from what I study and comprehend until I stop paying lease, turn into a "issue"(authorities, sound, damage of home) my rental stands the term.
