i was riding my longboard on a public street because there was no sidewalks, and there was no vehicles , he pulled me over and and i stood there waiting for him as he walked up to me, i asked him what did i do then he said put the longboard down. my mom called my phone and i had it in my hand to answer and he grabbed it out of my hand. as i backed up he said "you dont wanna do this then he grabbed his taser gun, then he put my hands behind my back and put cuffs on me tightly without saying what i had done. after he searched me, he put me in the car and said i was charged with Operation On Public Roadway Prohibited. he didnt explain other then i cant ride a longboard on public property it has to be on private property.
When i saw him typing on his pd chat copmuter he typed"Male on Longboard" and dispach replied "Male on a LONGHORN? lol" and the officer typed NO a LONGBOARD, But LONGHORNS are legal lol" he released me to my mom(im 17 and he didnt feel "safe" releasing me). ironically, he pulled me over at a cement public trail for riding on. can i really get a citation from riding a longboard on a public street that had no sidewalks?? I dont see how longboards are "ALL TERRAIN VEHICLES" as it states in the code
" § 663.037. OPERATION ON PUBLIC ROADWAY PROHIBITED. (a) A
person may not operate an all-terrain vehicle on a public street,
road, or highway except as provided by this section.
(b) The operator of an all-terrain vehicle may drive the
vehicle across a public street, road, or highway that is not an
interstate or limited-access highway, if the operator:
(1) brings the vehicle to a complete stop before
crossing the shoulder or main traveled way of the roadway;
(2) yields the right-of-way to oncoming traffic that
is an immediate hazard"
this is a regular longboard no motor or anything. i couldnt ride on the grass and it was my trasnportation was my board, and there was no traffic.
NOTE: i ride this same road daily on my way home from school, and no one stops me at all.
Can i fight this 265 dollar ticket??
