A product damaged my skin, can I sue?

Postby rushford79 » Wed May 30, 2012 8:57 am

I purchased a pair of black patent ankle boots from Deichman shoes and after a few wears I noticed thick black lines around my legs exactly where the top of the boots rest.I assumed it was just transfer and would wash off but it wouldn't wash away. I stopped wearing the boots and after a week, the marks were still there and are still visible now, weeks later. I am very distressed about this as they are very visible and I am afraid they may be permanent scars.

I am not sure what to do as the website says if a customer is 'dissatisfied' they will refund the purchased price, but this is much more than dissatisfaction. What can I do?

You should have discontinued use when you saw they were too tight. Common sense.

The first thing I would do is to alert the company to the problem. And add that you are "dissatisfied" with the product because of this. Don't make any threats about suing them -- just let them know the problem and that you are dissatisfied.

My best be is that the dark lines will fade away. Unless the boots were in touch with broken skin -- like ink in a tattoo -- I think it will fade away as your skin sloughs off.

Actually, I have had occasions where shoe dye discolored my feet. It has always faded away in time.

If the dark line doesn't go away in awhile, then get in touch with an attorney. But I think it will fade away and you will be as good as new!

I think you should get in touch with your local trading standards office...get the details from your town hall, I wouldn't bother suing for this as it'll cost you maybe a couple of thousand pounds more than you can expect to be awarded. Trading Standards can look into the matter for you...get some photographic evidence of the marks on your legs and get a doctor's opinion on the damage caused.
