A Trademark question?

Postby kalvin71 » Fri Apr 01, 2011 7:25 am

I am starting a business, LintFree Dryer Vent Cleaning. There is a Trademark for Lint-Free. The way the name is written is different. Will this be an infridgement on that trademark?

A Trademark question?

Possibly.

If your use of the mark (even the name without stylization) may cause confusion in the consumer market OR may make consumers think that LintFree Dryer Vent Cleaning and Lint-Free are related businesses, you are violating the mark.

What kind of business is the other "Lint-Free"?

UPDATE: It sounds like you are in completely different businesses and there is little possibility of confusion. Therefore, you are most likely okay with your trademark. However, you should consult an attorney in your area as a matter of course.
