My difficulty demands bankruptcy in their state of: Oregon<br />
In 1997 I filed Chapter 7, and it had been released in June 1997. Ever since then I've been approached with a collections organization that claims I received a debt in 1994. I did not understand of the debt (or I'd have shown it) and I read that below a 'no asset' bankruptcy in the Ninth Circuit that you can amend your bankruptcy to add a creditor. If I wasn't approached concerning the debt till 2002, on the other hand in 2008, may I still amend my bankruptcy to add the debt?

In a Chapter 7 asset case an unpublished debt is not released if you don't could show the creditor had notice or really understood about your bankruptcy over time to file an evidence of state - usually within 3 months of the 341 meeting.<br />
Many courts state that obligations listed in a zero-resource case are released since the lender would not obtain anything even if your debt was listed. <br />
In the case of unlisted debts, you've to show that within your legislation, unlisted debts in no-asset cases are removed and that yours was a no-asset case. Occasionally you've to employ an attorney to create this point.<br />
Bear in mind that some obligations aren't released in bankruptcy.
