Are we entitled to sue for an escalator related injury?

Postby kevloft » Wed Oct 30, 2013 10:10 am

Last week while visiting a mall out of town, my aunt and a couple of her friends happened to suffer a fall off the escalator near its bottom. What happened was, the escalator happened to jerk to a sudden stop all of a sudden and quite a few people were shook off balance although most of them held on. My aunt happened to fall and broke her wrist. Her wrist and her arm is now in a cast and she has been advised rest. Now I know for a fact that she is not to blame. Everyone who gathered around after she fell were surprised as to how hard it jerked to a stop. What I'd like to know is whether we can sue the management of the mall for the injuries caused to her. I was reading about all this online and came across this page- http://www.sommersandroth.com/areas-of-law-practice/personal-injury/ . It says that even slips and falls that are caused by the negligence of others that puts you in danger or risk of injury are eligible for compensation claims. Is this true? Could someone shed some light on this? Should I consult with a lawyer?
