Auto insurance claim/ personal injury?

Postby ealahweemah72 » Fri Oct 28, 2011 11:01 am

So I got my 1st offer from the insurance claim made because of injuries I suffered in an auto accident in November of 2010. They seriously low balled me, which is to be expected...but what i didn't expect was that part of their reasoning is that...they think 6 months of chiropractic care is excessive so they only want to pay for 10 weeks worth. Cuz I should have just been magically healed in 10 weeks. What I don't think is reasonable is that they don't want to pay in full on a claim made against their client who was UNLICENSED at the time of the accident. So, question is....what do I do here? I am looking into getting a lawyer. Didn't want to because the personal injury limits were so low that I'd just be giving away all the money to the attorney. We already got screwed on the property damages being as they were above the liability limits as well. Someone's getting sued? Can someone just give me advice or let me know how they handles a similar situation?

I don't think there are many things in life as frustrating as dealing with an insurance company in a situation like you are going through. I would really shop around for a lawyer and bargain with them for the best % they would take your case for. Then I would call the adjuster and tell him you are getting an attorney(tell him the name of the attorney so he will know your are serious). Ask him/her to give their best shot as you want to see which option is the best. By the way, you may want to tell them the name of the best attorney in the area as they may know of him/her. Good luck. Don't lose too much sleep, like I have.

While this may not help you this time, I figured I should weigh in here. Many attorneys will be hesitant to take on your case this late in the game. You've already been speaking with the insurance company, you've probably submitted medical bills, you may have given them a figure that you feel they owe, and ALL of these things will only hurt your case. The insurance company ALWAYS has an ulterior motive when speaking with you; there is no question that they are taking every opportunity to attempt to reduce their liability, cast doubt on your story, etc.

An attorney may cost 33%, but I promise, those who have a good case, who hire an attorney from the beginning come home with more money in their pocket 99.9% of the time.

Now, this is not to say that you WONT find an attorney, but the amount they will be able to increase your offer by, is going to be very small. Speak with some personal injury attorneys and find one who will NOT take a fee on what you have already been offered, but only what they are able to increase your offer by.
