Would an insurance company drag their feet in a personal injury claim?

Postby treasigh » Fri May 04, 2012 5:46 am

I am dealing with State Farm and they are claiming that they have not received a letter of representation from my attorney or any medical release forms. I have contacted them three times and told the lawyer that they have denied receipt and instructed him to resend. I did not hear anything from the lawyer or State Farm for months, and today State Farm tells me they STILL do not have the information. What should I do? Is my lawyer not sending the information? I don't want to get the lawyer angry with me, but I am one step away from asking for proof that it was actually sent. The lack of communication from this guy is unbelievable. Never returns phone calls/emails.

If the insurance company receives a LOR from an attorney, they act immediately. State Farm is a reputable company, and would not be lying to you for months about not receiving the info.
It is quite possible that your attorney is not putting the proper information on the documents, and they are not getting to the correct people.
Make sure each page has your claim number on it, and it goes to the proper address. You also might want to ask your adjuster for the fax number in their office, and see if your attorney will fax it.
Make sure your attorney has the correct claim number, address and fax.

It's also possible that your attorney hasn't sent the LOR at all.

You can go to your State Insurance Department and start a case with the consumer servcies division. State Farm has a limited number of days to respond and pay, if they do not they can be penalized by the State with fines. Call your Stae Insurance Department consumer services division and they will assign a case worker to your file, in addition ask your lawyer to provide the receipts for the Confirmation Mail, he should had sent anything like that via certified mail, if he did not, then you should not be using that ambulance chaser.

Good luck

You should have an injury lawyer who will speak on your behalf, it will make things a lot more smooth and you won't have the stress of chasing them down yourself. Most lawyers will offer a free consult, so I would start there.
