Postby aldous » Sun Dec 29, 2013 6:51 pm

My difficulty needs a purchaser regulation dilemma in their State of: Ga
I was investing in a Dodge from the Dodge Dealership in GA. I decided to trade-in our 1997 Nissan Maxima and gave the dealer $4000 deposit for $500. I was informed the automobile could be shipped early the next week due to the fact I was there on the Friday, Nov 11, 2011. 4 days later, i received a get in touch with from the seller saying so I needed seriously to are obtainable in to sign a brand new contract that the wrong contract were signed by me. I named the salesman and informed her that I wasn't comfortable with signing any new agreement and that I wasn't comfortable with ongoing with the provide. On Saturday, Nov 19, they explained the car was offered these days for collection. At that stage, I informed them once again that I wasn't comfortable with continue with the supply. The supervisor these days will not return my $4000 and he's requiring that I give the trade-in to him or he'll have me imprisoned. He's the title for the industry in. they requested a brand new title, Because that time, I visited another supplier and I could purchase a vehicle from their retailer. They are in possession of the Maxima.
Please provide me with some advice with regards to how I will get the deposit in addition to what my rights have been in their state of GA.

Auto Dealer Refusing To Return Refund

The problem with the contract you signed was exactly what?
A minor clerical error would not normally be grounds to escape a contract.

He's the title to the trade in. Since then, I went to another supplier, they requested a new title and I was ready to buy a vehicle from them. They are in possession of the Maxima.

Okay, my understanding is that "He's the title for the trade-in" means the very first seller has the initial title that you signed to him in his control?
Then you visited another dealer and exchanged the maxima inside, but you did not have the name for the maxima since you closed it to the very first dealer. What paper-work did you signal so the minute seller might get a brand-new/duplicate/alternative name for the maxima from cars? It would not have now been an MV-1 dropped name demand type, could it? If that's the case it might just be deceptive and punishable with an excellent up to $5,000 and or imprisonment of up to 5 years in jail.

Depending on what you signed, you may not be entitled to receive it back.
