Bacterial Meningitis Malpractice... Is it one of the more likely to win malpractice cases?

OK so if someone went the ER at 10p.m. and the ER was completely empty and the person had bacterial meningitis but was told by the doctor that it was just an ear infection. The person refused to leave, and they were finally given a spinal tap at 6a.m. the next morning. My main question is, is this a good standing for a malpractice case. What are the chances of winning a case like this?

NOTE: the person died the day after spinal tap when antibiotics could have been started if they would have been diagnose properly.

Your PROOF is? What does your Atty tell you? Was the Meningitis so far along that even if started antibiotics would have done no good? Do you have a Doctor lined up to testify for you? Do their myriad of high power Attys have witnesses line up a mile long? Way to many question to reply properly so go see a Malpractive Atty.

if they where that close to death then the antibiotics may well have not had enough time to save them, as some one that has had this type of meningitis 2 and the other sort 3 times when I go in for the same type of symptoms they check me out at once..but ONLY due to my past history.

I honestly do not think you have much of a case as there is NO way to prove that antibiotics started at that close to them dying would have had any effect............you are talking of less than 8 hours from them going to the ER and the spinal tap being done.............

My instant question would be WHY did they wait so long before going to seek help.......as I said I have had this and you are so sick that you go wayyyyyyyyyy before this point
