Being Sued For Medical Bills.

Postby Jakome » Sun May 25, 2014 1:57 pm

I was just served with papers this morning, I am being sued by a hospital for money I owe. As of now my wages are being garnished due to a unpaid student loan. I filed bankruptcy like 3 1/2 years ago and I feel stuck. I have bills to pay to live and have to take care of my sons needs. Any advice?

There's not much that can be done.  There is a maximum that can be garnished, so I suspect that may have already been reached with the first garnishment.  If that is not the case, then the only out(not a good one) is to file Chapter 13.  All that would do is stretch out the payments longer(and stop interest from running).  But then you have to pay an attorney and fees to the trustee.  Probably the best thing to do is attend the garnishment hearing.  If they take so much out of your salary that you can't handle it, then Chapter 13 may work.  Sorry -- it's not a good situation.

(I am assuming that the hospital bills were incurred after the bankruptcy was filed.  Otherwise they would be discharged in the bankruptcy).
