There's no constitutional to reduce analysis. If he was utilizing means completely invasive enough to represent a research without probable cause you then may have an underlying cause of motion however it must be recognized just what he's performing, who he's allegedly viewing, etc.--load us in about the specifics if you're able to. How will you understand he is a policeman?

In theory, if you walk up to him and tell him you know he is a cop, most likely he will leave.

I concur that it's possibly a PI. If you like to understand without a doubt, contact law enforcement and record a dubious individual/automobile hanging out. When they appear, it's not likely a policeman. When the man leaves soon after you contact, nicely, you are able to determine it out.

Estimating JoeW
Theoretically, should you walk-up to him and inform him you realize he's a policeman, probably he'll leave.

Why? If which was what he was designated to complete, he'll likely remain. But, his superiors might later alter the technique of surveillance.
I would say it's much more likely a personal detective. Law enforcement seldom possess the assets to park somebody outside a home... And when the individual they're viewing IS TRULY poor, they're likely to consider steps which are a bit more covert.
In most scenario such as this that I've run into, the viewer is just a personal investigator.
