California Labor Law - time between working shifts?

Postby ruelle » Mon Apr 11, 2011 1:39 am

My husband works in the entertainment industry and from time to time he wont get off until 4am (after working a 19 hour shift) and then has to be back in at 10am..that is only a 6 hour "break". Is that legal?? I live in California. Isn't there a law that says employers have to give you a minimum of 8hours between shifts?

California Labor Law - time between working shifts?

With a very few industry specific exceptions, there is no required time off between shifts in any state.

You have the right to refuse if you don't mind being fired. The ONLY time you have a guaranteed and protected right to refuse (and this right only exists in CA) is if you have already worked 72 hours within the same work week. ONLY THEN is the employer prohibited from taking any adverse action against you for the refusal, regardless of how much notice you did or did not get. }{
