California Retroactive Assistance

Postby Erwinek » Wed Mar 12, 2014 4:19 pm

We're at the moment just spending debts for my partners child. She's 19 and coping with us at the moment. The caretaker gets $550/month at this time and my partners income lower income (I'm a complete time student and mom of 3 without any extra income) we cannot afford to pay for this sum. I'm attempting to return to court and have the amount decreased and in the same time notice when the debts paid where not miscalculated because of the court placing the amount
on his money at that time of reading and must it-not have now been determined on what he created throughout the 24 months the rear help was billed?
I'm believe if selecting a lawyer but if I might have success by myself. I instead pay for the kid compared to lawyer, thanks for any help

Florida Retroactive Support

Estimating lenalogan

Per Florida law, the state can go back 2 years and they did that when they established the first support in 2007. They required the amount he gained at the time of preliminary hearing wich was $ 18.00/H which established at 550 monthly ($ 27 for backsupport) My husband didn't generate $18 in 2005 or 2006 (I understand we're quite late on this but difficult time have actually struck people now) While we sumbitted a demand for a hearing in 2008 (think this or not) They'd an hearing without my husband present and refused the request. The amount we're now spending is stricktly debts,Child is 19 now. and coping with us.

Your spouse can't do something today about how exactly the retro assistance was decided, he just had 12 months by which to complete that.
At this time, there is not something your spouse may do, but it will not hurt for him to obtain a consult anyhow, it will make him feel much better about not having the ability to do anything.

First please realize that you can't do something apart from study for the spouse because you aren't an event to his CS case.
When and how were the debts decided?
May be the 0 the previously court-ordered quantity that's for debts and present assistance?
Your partner really must consider copies of of his court requests to some nearby lawyer to get a consult. He is able to obtain a inexpensive consult by contacting the Florida Bar Lawyer Referral Service at 1-800-342-8011 or online at:http://www.floridabar.org/divpgm/lro...rral6?OpenForm
ETA: What happened whenever your spouse attempted to return to judge for this in 2008?:http://www.expertlaw.com/boards/showthread.php?t=50638
