Can a citation be written in a traffic stop when the officer's flashing lights aren't on?

I was driving tonight and apparently speeding when I turned into the Wal Mart parking lot, where an officer turned in behind me and asked if I knew how fast I was going. His flashing lights were not on and he gave me no sign he was writing a ticket until he started the process. I had no idea I was even in trouble until he began. Is that legal?

legal - you got the ticket because you were not paying attention and did not see him, if you had slowed down immediately he came behind you he would probably have just continued on his way provided your speed was not excessive

Yes, it can be done in this manner. It is completely legal.
