Can a defendant be switched in a Personal Injury Lawsuit from a Car Accident ?? And can Bankruptcy help ?

Postby sheridan93 » Sun Jun 17, 2012 8:18 pm

So i was involved in a car accident 6 months ago that i was found fault (a car cut me off so i swerved to try and avoid him and hit a car head on) so the car was mine but the insurance policy was under my fathers name. Basically I got a lawsuit letter today and said my father was being sued for $150,000 in medical bills and $36,000 in lost wages from the driver I hit. So basically i wanted to know if If instead of my father being sued I can be the one being sued cause I feel I should take responsibility. And I was thinking just to file Bankruptcy to avoid this whole thing what do you guys think ???

Im sorry to hear someone was injured badly, part of being an experienced driver is you have to pay attention and know where that car is going to go when you turn the wheel. It would have been a lot better to smash into the idiot who cut into you than to swerve wildly out of control and smash into a head on.
Insurance companies follow the money. In this case since your dad is the legal owner of the car he is responsible for any damage you or anyone else does in it. you were the driver and if you had a house and property or multiple properties your name would be on the law suit too. Since it was likely your dad with the house and properties and he is the owner of the car then your dad is who the insurance company is going after.
Filing banruptcy is not the answer.

either way your dads name is on the policy and there is a good chance he owned the car at some point in anycase having his name on the policy with you driving and not on the policy could be considered fraud too this case just gets better and betteer good luck

If the lawyers thought you had the ability to pay, they would have filed against you in the first place. They actually expect your father's insurance company to pay.
