Can I put a lien on his property?

Postby joachim » Mon Jul 30, 2012 12:20 pm

I recently won a case in small claims court against someone who owes me money (he was getting a large sum of money and wrote me a check for my portion, which bounced because he used it for his own personal interests). It's my understanding that there is no time frame in which the person has to pay, or that any further action will be taken if he doesn't pay. He is selling his house and will make a decent profit, I know this is the only opportunity for me to collect the money in one lump sum without having to wait a ridiculous amount of time. Can I put a lien on the house so that he will be obligated to pay once it sells or goes into foreclosure?

Side note: This is not me trying to screw someone over who is in need. He is a deadbeat that screwed me over and will continue to be this way with all of the people in his life. We have a history together and I know he needs to be forced to pay me, as he will never willingly do it on his own. He will be taken care of by his family, so me collecting what's owed to me will not, in any way, put him on the streets.

If you have been awarded a judgment by the court, you have the right to place on lien on the debtor's real estate. Contact the court and ask them how to go about it. Do it quickly - you need to act before there is a sales contract on his house. You can also give the judgment to a collection agency and let them try to collect.

The last time I won in court, I placed the lien on the person's house that same day. I may never see the money, but he can't sell the property and provide clear title to his buyer without paying me off!
