Can i sue a hospital for medical malpractice?

Postby lintun » Sat May 12, 2012 11:03 am

i was going in to be induced on the 27th of march i dilated to 7 by the next day, one of the nurses took me off the pitocin(medicine to make you dilate) a hour later i went back to a 5 .by then i was in labor for 30 hours so my doctor wanted to do a csection. i really wanted to avoid this. she said she was going to eat lunch and be back in 45 min to see if i had progressed. she came back 15 Min's later and decided to do the csection. like she was in a rush. i went into the surgery room and the could not numb me enough so they put me to sleep. when i woke up the nurse told me the doctor cut my baby's face. the doctor said it was just a scratch, and then left, when i saw my baby he had stitch strips on his face with blood. 45 Min's later i complained i didn't feel right and a nurse came to check my blood pressure it was 62/20 next thing emergency staff come in and start pushing me to the surgery room again choking me with Oxygen mask im balling my eyes out scared so they put me back to sleep they left my placenta in. ............ after that they give me two blood transfusions. i leave the hospital two days later. i come back to the ER the next day reporting i feel weak and loss of appetite comes to find out my hemaglobe is 6.4 i was really upset i didnt want to stay back in the hospital but i had to get more blood transfusions i felt better after that and went home couple days later i had to go back for the same reason because they did not check my hemaglobe when i left the first time and it was only a 7.3, your not suppose to leave hospital unless its at a 8. I went through hell having my first baby and didnt even get a sorry my doctor went on vacation right after my csection and they had to call her back for my 2nd surgery. im very unhappy and my poor baby has a huge scar on his cheek

Yes, you can.

Choose your attorney wisely. Do not just go with the first lawyer you talk to. Medmal is a specialized area of law. It differs from state to state, and so I cant tell you what to expect, but you will need to get someone who is capable.

Good luck.

You can try but don't get your hopes too high. Doctors will lie under oath to protect each other, it's sort of an unwritten code of conduct most of them subscribe to. Like I will watch your back and you watch mine.

You may be able to sue of you find another doctor that can testify that your treatment was substandard and not in accordance with proper care and quality.

Frankly, other than the cut, which is a risk in any C section, I don't see that anything was done wrong. Your blood issue is common, and it sounds like they dealt with it as it happened.

The scar on the baby's cheek will fade within a very short while, it will NOT result in a 'huge scar'

I don't see a case here.

You likely signed a document before the c.section that will make winning difficult.

What exactly do you think they did wrong? Your labour wasn't progressing so they did a c-section.Your hemoglobin was low and they treated it.
