Can I Sue amazon for closing my account WRONGFULLY?

Postby mate » Tue Apr 10, 2012 11:17 am

Hello, I Recently opened an account with amazon to sell products. I bought lots of merchandise & cheap accessories. The approximate value of re-sale is about fifteen thousand dollars. During the first 20 days I was selling well and suddenly I received an email where stated that my account has being closed because it was related to another account that was closed before. I contact them and told them I had never opened an account with amazon and maybe a mistake. They responded me by saying they had enough evidence to keep the account closed and in fact my new account is linked to another. After reading multiple forums on the internet and understand how they track computers, IP address and others, I noticed that my future ex husband had an account with Amazon but they shutdown for I don't why. I do not live with him for the past 12 months, I have a different address an a new bank account with my own money and so on. I wrote back but I was told on the last email that they were not going to re open my account. My internet connection is new but I did use my old computer from our previous home. I guess that's why they think I'm linked in some way with my husband's account, which is not so. Now I have all that merchandise and it is very difficult to find or rather not found another possible mechanism to sell my products other than amazon or ebay. I am making making sure before I open my ebay store, what needs to done for this not to happen with ebay also. Now amazon is holding around $ 3,400.00 from my 20 first days of sells and now they want me to wait 90 days to get my money back however, I'm pretty sure that if I don't do something they are going to withdraw that money to my husband account for whatever monies he might own to amazon. My question to you is that if I have enough grounds to sue then for brief of contract by accusing me directly to have another account with then or per said that my account is linked with another closing account. If you guys things I can win a lawsuit with this argument were I HAD NEVER OPEN AN ACCOUNT with then wish is the mean reason why my account was closed - Can I sue then for damages, brief of contract, defamation of character, mental anguish, stress, or what you think I can sue for and How much. My final question is that, I live in a different state and I understand when you sue you need to do it on the defendants address. Any ideas or help PLEASE... Thanks.

Maybe, but the question you should as is it worth it? Describe your problem to an objective rational listener and ask them if they think it is worth it to try to sue the 270th (2011 number) largest company in the world. If you have any case only a lawyer might say, but with the legal firepower that I am sure they have, they could ending up costing you far more than what you are trying to recover.

You're making a big deal about nothing. Have you ever heard of the shops? Great place to buy things.

Also it isn't likely you'll win the case because this isn't a big deal and they have quite a few lawyers.

I think you need to go to a lawyer and get some proper professional advice. Can you use an alternative site in the meantime? What about an ebay shop?

If you read the print in their agreement it says that they can hold your money for 90 days and it doesn't give a very detailed reason under what circumstances they would do this. So, even though the account you are linked to is your ex-husband's and not your own, they are still going to hold your money. They are Not going to transfer the money to his account or give it to him. They are holding it to make sure your payments don't go bad (chargebacks) and then they'll let you have it.

FYI-PayPal, which is owned by eBay and is eBay main payment service does the same thing, so make sure that you follow all their rules and make sure there isn't an account lurking with PayPal to. And when you use eBay/PayPal, never, ever ship something without a tracking number and get a signature for anything over $250.00 or more.

"if I have enough grounds to sue then for brief of contract" Assuming you mean "breach" of contract, none has occurred. The contacted specifically states that Amazon has the right to reject the contract under these grounds, and to hold the balance of an account for ninety days.

"Can I sue then for damages," So far, you have none. Should they refuse to return your money outright, yes.

"brief of contract" Again, no.

"defamation of character" None has occurred. At least, you have mentioned none.

"mental anguish, stress" Certainly not. Well, sure you can sue, but damages aren't awarded for inconvenience.
