Can I sue my landlord for wrongful eviction and lying on documents?

Postby arne33 » Thu Mar 01, 2012 10:22 pm

Long story short my fiance's aunt contacted us saying that she had bought a house for my fiance; for the one she sold when his mother pass that was to go to him, and that she wanted to right past wrongs. She told us the house was ours and that she just needed help paying for the repairs that it would be $400 a month for six months we all greed to this. In fact my so to be father in law came over and did some work for free for us before we move in. She told him the same thing she told us, the house was ours, we are to paid for the repairs $400 for six months. We move in 9/19/2011 At the end of Oct the water from the bath tub would come from under the bathtub when you ran the shower or let the bath water out. At first we thought that the person who did the plumbing didn't tighten the drain pipe well we all found out later that she never fix or replace drain and sewer pipes that she told us she did and that we were paying for. She then had to replace all the sewer pipes, at that time we were without a bathroom from two weeks, we had to wash dishes in a tub take showers at my mom's and use a bucket to piss in. She paid two men a $100 each and spent $75 on the pipes She even try to go from six moths to 3 years then to 2 years of us paying $400 a month. We were ever upset at this and told her that we want every thing in writing and wanted to see receipts. That we agreed to 400 a moth for 6 months not 2 years. She told us that she will have a everything wrote up and all price's for the repairs listed. Nov came we paid her and even a $125 more at that time she was telling us how sorry she was and that the guys had rip her off and that she would be by later with the letter. At the end of Nov she told us that she was having a lawyer write everything up and we thought this would be a great ideal and that she would have every thing by the middle of Dec. She never came by Dec with the paper work. On Dec 30 she text us asking for 500 on 1/3/2012 I text her back that I'll will give her a $500 money order in her name, she never came by but it's not the first time she been late picking up money so we didn't think nothing of it she always comes in a day or two. The next day we have some lady posting a 3 day notice for non payment of Jan 1/3/2012 in the amount of $1,225. We contacted the number on the notice told them everything and that we have her money that she ask for in the text, we never got a call back from her or her lawyer. So we gave the courts everything the texts and witness. We never got a court hearing we even paid the money (that we agreed to in the texts) to the courts but they still evicted us Can we sue her and if we can, how much? or How can we sue her. She texts us after we were evicted telling us she was sorry and that she would pay us back, we told her that we want nothing to do with her and that we would mail her the keys. Two days later she texts us threatening us and our kids. She is lying to the family saying that she evicted us because we didn't pay her for months, we had to show the family the eviction paper which goes against what she is telling everyone, people were shock, well not all of them. She also lie about owning the house herself, it's in her name and her boyfriends name, we never talk to him about the house. We cant get a nice apartment now and the places that will let us in are not were you want your family going and they want 3 to 4 months of rent up front all because of lie's.

This has small claims court written all over it

Take her to small claims it only costs like $40 to file

make sure you get written statements from as many witnesses as possible.

She could not have legally evicted you without a court order. In order to get that, you should have been notified when you had to appear in court. That was the time to tell your story.

If you never got a court hearing but still paid the court, then it would appear that you did not appear on the date you were told to appear.

If you are still living in the house, wait until the Sheriff comes to your door to prove that a legal eviction is about to occur.

Never do any kind of business with relatives. She could not have sold the first house if her name was not on the title. Find a new place and stop speaking to the aunt.
