Can I sue my teacher ?

I'm in a nursing program & yesterday we were taking an anatomy & physiology test . it was over , we went to lunch , came back , the teacher lectured & gave us our test back & went for break I received a 96% on the test which is usual for me , for the simple fact I have NO life because of this program and study my a*s off everyday . anyways during the break the teacher said she would like to speak to me so I went w/her , she took me to the director of nursing office which was odd & the teacher basically said that she THINKS she saw me cheating & she THINKS she heard me about to say something , (how do you think you hear somebody about to say something ????) anyways they told me I basically get a 0% for this exam , because they have this dumb policy that even of they think you're cheating u get a 0% , I was devastated & started crying so much that I had to leave school for the day & I'm still crying this morning .


so basically can I sue my TEACHER for wrongly accusing me of cheating & also for slander ???

No but talk to your dean or princapal and see what they say or your parents that may help

I would definitely see an attorney to see what your options are. The policy they say that they have about giving out 0% if they even suspect cheating does not sound legal. Basically they are saying they can give out failing grades on a whim, which is definitely not legal. Did you sign something when you entered the nursing program that said they could do that? If not, you have a shot. This truly is devastating on so many levels and I can see why you would be upset. I think you should move forward with this so the school has to legally change the way they do things and you prevent this kind of thing from happening to other students in the future. Personally I would sue the school.

No. It's her opinion and the school has rules she'd following. You can't sue for an opinion and you can't sue for slander unless she runs around telling everyone you're a cheat. You may be able to sue the school about the rule but that's it.

If yu want to ask what must be proved in a slander suit, ask that. You asked can you sue. You can sue anyone for anything.
Slander involves false statement of fact. An expression of opinion cannot be slanderous. She expressed opinions.

Sure you can sue but win, no way in hell. So why are you here crying over this instead of going to the head of the program or school? Your previous grades and experiences should prove you are capable of the score you received.

Stop with the bullshit about suing and start learning how to fix this if it can be fixed.

Yes, im pretty sure you can because you pay to go to school and that just gets your reputation and your skills thrown down the drain. I know a teachers helper who got accused of cheating and now he can never become a teacher plus they charged him 15 thousand dollars and kicked him out of college
