Can i take possesion of my rental if tenant has abandoned the property more than 7 days in New Mexico?

tenant left some furniture...and trash..locked the property some curtains...have not been living there as water and gas are cuttoff...

do i ahve the right to enter now..or do i need to file eviction procedure

If the tenant has clearly vacated the property you have the right to enter in order to preserve it and make it ready for the next tenant. You must store the previous tenants property for a certain period of time and you are allowed to charge storage fees, you must make an attempt (registered letter to last known address) to notify them that their stuff is in storage and the date when you no longer have to store it and will sell it or give it to goodwill.
