What is legal malpractice? Is it when a lawyer does anything unfair and harm the rights of the other party?
One particular of my very good friends (who could not afford an attorney filed her own response with a signed waiver to wave the filing charges hand delivered it to the court.(this is a divorce and custody situation) 3 days ago she had her two youngsters taken away. papers said default on the response .
Which the court has record of the response it was just the waiver that was denied.Know one via the courts has notified her of this getting denied.
Via this entire factor she has never ever recieved anything from the courts or the other parents attorney..I know from my personal legal scenario that my attorney sends copies of almost everything to the other party.. What happened here.
The lawyer in this case failed to give her a ten notice of default..which had shed identified she could have came up with filing costs somehow.
What are her rights and do you feel there was any wrong carrying out (in a legal way?)
