Can you get in trouble if you admit to doing drugs on an internet video?

Postby gabrielo19 » Thu Feb 23, 2012 8:02 pm

I was watching that video - California on 420 - can't all those people get in trouble with the law since they just publicly admitted to partake in smoking an illegal substance?

Doesn't Cali have medical MJ? Not illegal then...
side note: I live in Colorado, and my buddy is on medical MJ, and his probation officer was forced by a judge to allow him to keep smoking it (under recommendation from 3 different dr.s)

No. Its not a real confession. Have you ever seen a comedy show where people pretend to be high? Unless theres actual evidence on the video of them doing it, and the evidence is definitive, then no crime was commited.

And of course, even someone who confesses to a crime is not automatically guilty. Some people have confessed to murders that they could not have possibly in any way commited, and so despite a confession, were not convicted. Because they didnt do it.

I just killed the Pope.

Hmm, no arrest. How weird.

In court, evidence needs to be substantiated by testimony. And testimony also needs to be substantied by evidence. Although a video might be testimony, it's certainly not evidence. Just like there's no evidence that I killed the Pope.

You'll notice that there are several items necessary to charge someone with a crime. Besides the crime, itself, the charge must also stipulate when and where the crime occurred. It doesn't have to be precisely exact, but "sometime during the 21st century on the planet earth" doesn't make it evidence.
