Cant sue because Statute of limitations after time?

Postby ahanu » Sun Mar 04, 2012 3:30 am

I had a bad experience with a denstist. He pulled my tooth in middle top back, and then cut my gums repeately with a knife and pulled out the nerve or blood vessel upset. I told him to leave the room, I had a knife, sounds of a officer arresting him. Im not welcomed at this health center. They always on my as. Its been about 2 years and I been having burning pain with sinus on that side of face, from the same upper side to eye,forehead,..... I contacted a lawyer planning to see a oral surgeon to see if it can be fixed but he wrote"
In general the statute of limitations for medical malpractice is 2 1/2 years from the date of the malp..
If your case involves an institution run or funded by government, that requires a notice of claim to be filed within 90 days of the malpractice. For wrongful death claim, you must make a claim within 2 yrs. of the date of death.
I wanted to get out the day and thought it would just heal and that since he been arrested it was known. but i been thinking of seeing a oral surgeon for relief of pain. Bill just for me after because of statute of limitations @ dentist fault??....... another different field of lawyer??

Another lawyer is going to be constrained by the same laws as the one you spoke to.

Once the statute of limitations has passed, there is nothing any lawyer can do. Even if you found one who would take your money to file the paper work, the dentist simply has to answer with an affirmative defense stating the statute of limitations has run out and the case will be dismissed.

If you don't believe the lawyer, look up the SOL's. Most state codes are online. Generally the med mal rules are under their own section... so not that hard to find. BTW your writing is horrible. Don't rep yourself.
