I was currently, well a couple months ago involved in a car accident which was determined to be my fault. I rear ended someone. Im fine with it being put on me, I cant deny its not my fault. The cops were called and I ended up getting a ticket for "Failure to reduce speed". The problem is when it happened the guy YELLED and SWORE at me. Whatever people react different. But he threatened me saying I BETTER HAVE INSURANCE OR HES GOING TO SUE ME YADA YADA. Of course I did, full coverage so I wasn't worried. Well a couple days ago I got a letter from my insurance company stating the claim has been completed and we fixed his car. TODAY I got a letter from his insurance company stating at the time of the accident he DID NOT have insurance. My question is, is there any way I can take him to court. He told police he had insurace and showed them his card, so he can be skipped of a ticket. He KNEW he didnt have insurance. Does my insurance company know he didnt have insurance? Id call them but the claim dept is closed right now. So any info would be appreciated. THANK YOU! P.S. Im not trying to get money out of him or nothing. But im tired of uninsured people getting away with stuff when I pay mine EVERY MONTH!

Something can be done, what? I don't know. Think of it this way, if he didn't have insurance, he shouldn't have been driving, and if he shouldn't have been driving the accident probably wouldn't have happened. I would get anhold of your insurance company as soon as possible.

hire and at tourney and find out if the guy actually had insurance. don't do it yourself hons cause you will spend hours biting nails and and a attorney will get the answers you are seeking. i and if he don't turn around and sue him hons. lying to Police no insurance nothing.

Doesn't mater if he had insurance or not, it wasn't his fault. Your insurance knew he didn't have it, and also knew it didn't matter, so they paid to fix it. All you can do is hope they turned him in for driving without insurance and the state will take action against him. Unfortunately you won't know if they did.

whether he is or not is none of your business. YOU caused the incident and he sued you and you paid, your insurance company indemnifies you against that risk. That is all the insurance company does. If you hadn't paid voluntarily he'd have taken you to court to cover his losses (again your insurance company would indemnify you) and would have won.

None of your concern whether or not he had insurance. You were not the one suing him

Sure you can take him to court.

But you won't win anything and he may end up with a judgement against you.

His not having insurance does not change anything. You still struck his vehicle in the rear. You are still at fault.

If I took out a magic wand and *presto* magically made a valid insurance policy appear on his car prior to your hitting him....does the accident still happen? Yep.
So his lack of insurance is irrelevant. You can tell your claims department he did not have insurance but that does not change anything. You are still at fault. You are still responsible for his damages.

He yelled and you and threatened to sue. Also not illegal.

And, if you sue him....his counter suit is guaranteed. His neck will be sore. So, now his threat to sue is an actual law suit.

How do you know he "KNEW he didn't have insurance"?
Sometimes people make an honest mistake and miss a payment and the policy lapses.
He showed the cop the insurance card (which would have the effective dates of the policy and those dates would cover the date of the accident).

Get over it.

You hit him.
He acted horribly at the scene. It happens.

His lack of insurance does not change anything.

It's over.

about the only thing that will happen is he might get a ticket for no insurance. take the letter to the police dept and your insurance company.

There's nothing you or your insurance can do. The other party being uninsured has no bearing on the accident or the compensation he received. You caused the accident with your negligent driving, it wasn't because he was uninsured.
It wasn't illegal for him to yell at you and tell you he was going to sue you. People are allowed to get mad and yell. You have no case against him whatsoever. The police won't do anything at this late date, either.

What could you possibly take him to court for? Hurting your feelings? Lying to you?

His not having insurance is not your concern. You can't take him to court because his not having insurance does not affect you. If you were at fault, his insurance is immaterial anyway. Let it go.
