Change Of Venue & Having A Parent Get Supervised Custody

Postby Benito » Tue Jul 01, 2014 6:21 am

A year ago June my divorce was finalized in Palm Beach, Florida. A year prior to that, my ex husband stole kids, and during divorce procedures, I regained custody.  I live in Hernando county Florida.  I need to get a change of venue done to get jurisdiction to my area because I want to remove parental rights from my ex. He GAVE my 16 year old beer, and had one with him as he drank it.  He took my sick 8 yr old to a hockey game.  My 8 yr old had a 102 fever.  When I asked him why, he said because HE wanted to go, and the kid was fine.  He calls my daughter the bad C word, because she active in JROTC and cannot go on visitations as often as he wants, because she can't babysit the 8 yr old twins.  He will skip on a visitation because of a "hot Date" or to go to Miami for a photo shoot.  (he is in the process of becoming a model he says)

He got me fired from a job at a health club by calling a fake DCF claim about me.  As soon as the worker came to the house, she told me that she can tell it was fake, because claims were that I was letting one of the twins walk around with a broken neck.  He called the health club to tell them I was under investigation.  I was, because it takes time to finish paperwork, but was cleared of all allegations.  The health club had a day care facility in it, so I could not work there with a abuse claim on me.

He threatens to lower support because he needs money, but has no bills.  He lives with friends or family, and drives his mothers car because he don't want to pay for insurance or the vehicle.

I cannot afford an attorney.  I won the custody without one.  I just need to know HOW to change venue, and do I have to explain to judge why I want it?  I cannot find a form online, or even how I would go about it.  Do I have to go to court for a change of venue? I am sorry to go on and on in this.  I am worried for my children.  My daughter never went to a doctor when she was sick, and when he took the kids, the other twin had a major head injury which lead to a concussion due to him leaving him unattended. He never took to doctor, I had to when I saw him the days following the accident.  Can you please lead me in the right direction.

Thank you again

Change Of Venue & Having A Parent Get Supervised Custody

Hi Lisa, just file your action in the county you reside in. If he answers the action and does not contest venue, the venue will change. If he does contest venue, schedule a hearing on his motion and argue before the court why the venue should be changed. Venue for the most part is usually based upon the convenience of the parties and witnesses, proposed to be involved in the action. I hope this information was helpful to you.

This answer is based solely on the information you have provided in your question and as always, I would advise that you arrange for an in person consultation with an attorney from my firm or another Family Law attorney familiar with Florida Family Law who can analyze the specific facts and circumstances of the case more closely to better advise you.

Sincerely,

Daniel Bachert, Esq.
