City Stealing My Land

Having a dispute with a tenant or landlord? Rental Law discussion

City Stealing My Land

Postby Dillion » Thu Jun 26, 2014 3:50 am

OK, maybe not stealing.  I just pulled the "final map" on my property - 1/2 acre in the California City of Chula Vista, and discovered that the northern property boundry is located "Six Feet from the Curb".  Well, looking at the area, we have a curb, a four foot planter, where the city has planted some nice trees, a sidewalk, and then my boundry fence.

So, using the measure given to me by the city, my property line is about 3/4 of the way north of the sidewalk.

Can I ask the city to move the sidewalk, so that I can put my fence on my property line?  Why do I have to pay property taxes on land the city - or a prior developer - had placed a public sidewalk upon?  The city can put the sidewalk in the planter area - or, like many aread of the town, can have no sidewalk at all.

Thanks for your assistance.

have you obtained a copy of the platt map from the conty?

i would take a copy of that and take it to the city planning

department and get their idea as to what you can do--instead

of taking legal action.

also,

do u have title insurance?

if u do, call the title company.  they are insuring

two things; the name and the legals of the title.

their insurance firm's attorney can represent you.

get back to me
