Class Action Law Suit Eligibility? (DISHNETWORK)?

I have a question for any attorneys that may be able to help with an issue thousands across the US are having. As of last week Dish and Fox parted ways, and are no longer partners in programming. Meaning Fox programming has been blacked out and is not viewable. The programming currently includes regional Fox stations, and F/X. As of 11/1 Dish customers will lose local fox channel.

Last week I called and canceled my upgraded packages that no longer provided me the service I had recently enjoyed. This evening I called and canceled all service due to no resolutionn in sight. I am being charged a cancellation fee, for early termination. Though this is a breach of contract on their behalf do I have a case? These cancellations fee can range up to $200. Before hanging up with the operator she mentions they will apply these charges to my cc/debit card on file (provided at the time of initial sign up).

With thousands of customers leaving Dish due to their recent failed contract negotiation's; are they in breach of contract?

seriously doubt they are in breach but this is NOT the venue to determine that issue........

talk to a lawyer if you fell so strongly about watching Fox....




personally i would pay extra to not have to see their garbage programming be it news( so-called), local affiliates or regional sports (again so-called)...

If you are worried about them charging your debit/credit card then call the bank (or financial institution) that issued you the card and ask them to send you a new card with a new number because the one you have has been compromised. Dish can't make a charge to a card that is not active.

Guess you didn't read your "contract" very carefully - they are allowed to cancel stations at will - and you are not allowed to cancel service because they no longer carry the stations you want. Pony up the early cancellation fees Scott - or go find a crusader attorney who wants to buck DISH NETWORK!

Thanks for letting me know about the update on Fox. I watch a lot of shows on Fox myself and wont be happy until they get this resolved, and yes they will get it resolved, but the question is how long?

It's ironic since about 2 years ago, we had cable thu Bright-house and they had a dispute with the local channel 8 which was the channel for our Colts games. So to see the game, most everyone went to other peoples houses with DISH or Direct TV, or went to the bars to watch. We cancelled the cable and switched to DISH, but ironically the day we cancelled, they signed a new contract and got channel 8 back. At one time, some of the cable or Satellite companies could get the college games (that you had to pay extra for) or not. It is just a matter that every few years they decide they want more money so depending on the TV service you have, if they agree or not, and if they don't, then the subscriber loses.

For you, if you cancel, then unfortunately you will be out of pocket the early cancellation fee, but there will be thousands more like me who have fulfilled their contracts and may decide to change back to cable or to AT&T.

Personally, I believe they should reduce our bills with the lost of this station. Just like if you want certain channels, you pay more to get.

Even if someone was to get a class action lawsuit going, by the time the lawyers file it, most likely Fox will be back with DISH so it would be a moot point.
