Consumer Fraud..............?

Postby tate8 » Sun Oct 30, 2011 1:20 am

I bought Laptop from dell for $611 and that guy who was selling me Laptop on phone he told me my installment will be $19 per month for next 3 years and there will be no extra payment or interest charged on my payment and I confirm this statement from him 3 times on phone, he told me i have to pay $19 per month for 36 months. I bought this Laptop on phone and started making payments from same month and never check statement. Just recently this month when I check my statement i saw they have charged from last 6 months.

They are not even caring when I am calling them or sending them email about this topic. They just said minimum purchase should be $699 so you will not be charged for interest I said it was not mention in phone conversation when Laptop sold to me.

Where should I put complaint or something so I can get some positive response.

I'm assuming you did not buy this computer without a credit card AND a contract so read your contract. If they are deducting money not per the written contract, close out your account and open a new one.

Stop paying. Send them a certified letter, return receipt, saying they are in breach of contract. It is federal crime for them to send you a bill or phone you for money that you do not legally owe them. They may claim it was "an accounting error" if you give them the chance to explain what's going on, in writing. Stop calling them -- it's a waste of time and doesn't prove anything.

The contract is fraudulent if they told you one thing and (intentionally) charged you another. You can file a police report of fraud. They can try to sue you and you can point out the fraud as your defense and settle for agreeing to pay the original price.

NEVER pay any amount that you believe is disputed until you are ordered by a court or mediator.

err never buy crap over the phone, let this be a lesson, you ether go in a store and buy it or order off the dell website and read the fine print. what he said to you and whats on paper are two different things, he does not give a **** about anything but making a sale and getting commission.
I would call dell and scream, scream demand to talk to the manager and scream some more, then call dells head office and scream some more. the head office has a reputation to keep, they should sort it out.

dont cut you credit card off from the payments, the last thing you need is a legal law suit against you for not paying your computer bills.
