I'm obtaining a divorce after 21 years of marriage. I've been a stay-at-home mom for 17 years and have serious health issues (with Dr. confirmation). I'm requesting that my stbx be requested to maintain health insurance on me because of my serious problems and my medications alone might retail for around 1100 monthly if I'd no insurance. I'm only in a position to work a couple of hours each week so it's impossible I may find an employer to protect my medical health insurance. Does Ca actually issue a purchase that the ex should keep insurance even when the company he works for will not permit the him to keep me to the company strategy following the divorce is final? Thanks ahead of time for just about any help.

Do not decide something until you understand how much this all may cost you, because that cost is what you're looking to get included in spousal support."Obtaining my medication that I need on a regular basis is what Iam most concerned about and I've lots of tension over this. I'm certain I'm not insurable therefore this info is useful while I attempt to understand this whole prosess. Thanks for this information, every bit of advice helps!

Cobra is not cheap so if awarded it that will probably be part of any alimony settlement. Have you applied for SSDI?

In my own situation, X requested for insurance policy but was refused. About the other-hand, she declined to have psychiatric help when she was still coated and today has effectively utilized psychiatric "impairment" to obtain extreme spousal support.Interestingly, X had managed to persuade my medical health insurance that we were still committed and got almost annually of illusory additional coverage.* Ultimately they realized that she was resting when I included my new partner for the plan. Not just did X need certainly to pay the insurance provider, she dropped her choice to get COBRA coverage. She was fortunate that she was not punished for fraud from the national government.* Insurance provider wouldn't take my word for it and explained that I needed seriously to convince them that we were no further committed or they'd continue steadily to protect her! I replied that I knew of no text in my own insurance agreement that required me to show my integrity. I advised them that it had been their decision whether to carry on to protect her and I'd think no responsibility due to their decision. Therefore, anyhow, my undertake issues is that even although you do not get an order to be offered insurance protection, your extra medical costs could possibly be viewed for making a spousal support order.

Are you requesting for stbx to cover for personal insurance for you or that there to become some type of order that you be continued the organization plan?I doubt that the judge might issue a legitimate order for the latter (boss isn't an event to the situation, etc.). Regarding the former feasible issue, I'd believe that the judge would much more likely collection spousal support centered on your situation and pay you that approach but who knows.

I thought STBX would not be requested to retain me on his Organization Plan but maybe you have heard about a California Judge purchasing a STBX to protect health insurance because of long haul relationship and severe health problems? I did not understand if it had been heard of and did not notice something in the records that addresses this problem. Thanks.

He can be ordered to pay your Cobra payments but a court can't order a third party ( his company) to keep you on their insurance.

You will get COBRA (that will be extension of one's present health care insurance, but being an individual) from his company for three years. You've to pay for the entire cost-plus an administrative charge. While that operates out, then you can attempt to get a person plan, when you're rejected (which you'll be) you can qualify for their state insurance pool, or at-least access it the waiting list. Its not really a pretty picture when you yourself have medical issues. Do not decide something until you understand how much this all may cost you, because that cost is what you're looking to get included in spousal support.

No.
He is required to keep you on his insurance pending the dissolution.
The court can take the need for health insurance into account in deciding the proper amount of spousal support but it isn't going to order him to cover your health insurance after the divorce is final.
